1. Acceptance of Terms

By downloading, accessing, or using ReadBack (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

ReadBack provides an AI-powered aviation radio communication training platform. The Service is designed for educational and simulation purposes only. ReadBack is not a substitute for certified flight instruction, real-world air traffic control interactions, or any official aviation training program. Always follow your flight instructor's guidance and applicable aviation regulations.

3. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement.

4. User Accounts

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

5. Subscriptions and Payments

5.1 Free Tier

The free tier provides limited access to the Service as described on our pricing page. Features and limits may change at our discretion.

5.2 Paid Subscriptions

Paid subscriptions (Solo and Checkride plans) are billed on a monthly or annual basis. By subscribing, you authorize us to charge the applicable fees to your chosen payment method.

5.3 App Store Purchases

If you purchase a subscription through the Apple App Store or Google Play Store, the purchase is subject to the respective store's terms and conditions. Billing and refunds for in-app purchases are managed by the respective store.

5.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods. For App Store or Google Play subscriptions, cancellation must be done through the respective platform's subscription management.

5.5 Price Changes

We reserve the right to change subscription prices. We will provide reasonable notice of any price changes before they take effect.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to reverse-engineer, decompile, or disassemble the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Create multiple free accounts to circumvent usage limits
  • Share your account credentials with others
  • Use the Service to record or distribute copyrighted content
  • Use automated tools to access the Service (bots, scrapers, etc.)

7. Intellectual Property

The Service, including all content, features, software, and functionality, is owned by ReadBack and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial training purposes.

8. User Content

Voice recordings and other content you submit through the Service ("User Content") remain your property. By using the Service, you grant us a limited license to process your User Content solely for the purpose of providing the Service (e.g., speech recognition and AI feedback).

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. THE TRAINING PROVIDED IS FOR EDUCATIONAL SIMULATION ONLY AND DOES NOT GUARANTEE PROFICIENCY IN REAL-WORLD AVIATION COMMUNICATIONS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, READBACK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless ReadBack and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

14. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
